Original Description: Es handelt sich um ein schalenähnliches Erzeugnis aus Zink, in viertelkreisiger Grundform, im Wesentlichen bestehend aus 3 Seiten und einem Ablageboden, in Form von parallel angeordneten Drähten die zusammen einen Korb bilden.Das Erzeugnis wird in vorliegender Form ( Korb + Schrauben/Dübelset + Halterung) in einem Karton verpackt an den Kunden geliefert. Es dient als Ablageregal in der Dusche.- Antragstellerangaben -Der Korb stellt den charakterbestimmenden Bestandteil dar.Eine Einreihung der Ware als anderes Möbel in die Position 9403 kommt nicht in Betracht, da es sich nicht um ein Regal i. S. d. Anmerkung 2 a) zu Kapitel 94 handelt.Nach Änderungen der Erläuterungen zur KN bei der Position 9403; Amtsblatt der EU Nr. C333/I/02 vom 19. August 2021 sowie die ErlKN Position 9403 (KN) RZ 26.0 bis 41.0. sind sog. „Seifenschalen“ und „Schwammkörbe“/“Duschkörbe“ von der Position 9403 ausgeschlossen.Die Ware ist somit nach stofflicher Beschaffenheit einzureihen.Abbildung siehe Anlage.Derartige Waren gehören als „Andere Waren aus Zink, andere“ zum TARIC-Code7907 0000 90.
