  • The garment must show a distinct definition of cups or a separation of the breasts. This separation may be achieved through individual cups, or by stitching/gathering of fabric between the breasts.
  • The garment is designed to provide a body-supporting function, and not normally worn as outerwear.
• Heading 6114:
  • If a bra consists only of elastic at the bottom and does not provide breast separation, it falls under Heading 6114, not 6212.
  • If it is worn visibly as outerwear and does not provide breast support.
